This Privacy Policy explains our policy regarding the collection, use and disclosure of your personal
information. As are services are update and expand, this policy may change, so please refer back to it
periodically. By accessing our Web site or using our services, you consent to our information practices.
Collection and Use of Information
Personal information means information that can be used to identify and contact you, specifically your
name, postal address, e-mail address, payment method (e.g., credit card or debit card) and telephone
number, as well as other information when such information is combined with your personal information.
When you register or re-register at our Web site, we ask you to supply us with personal information so
that we can provide, enhance and personalize our services and marketing efforts. For similar reasons, we
may supplement the personal information you provide with publicly available information about you. We
use this personal information to process your registration, your orders and your payments, and to
communicate with you on these and other topics. We also use your e-mail address to send you
messages about Songdish special offers, promotional announcements and consumer surveys.
Occasionally, we may send these materials to you via postal mail, using the shipping address provided. If
you no longer want to receive the announcements, simply access the Communication settings with the
Profile section and uncheck those items to unsubscribe. Please note that you cannot unsubscribe from
certain correspondence from us, including messages relating to your account transactions.
We keep track of your interactions with us, including but not limited to your site activity, payment history
and correspondence. We use this information for such purposes as personalizing the site to better reflect
particular interests, tracking your available song sends, helping us quickly and efficiently respond to
inquiries and requests and otherwise enhancing our service offering for our customers. We also provide
analyses of our users in the aggregate to prospective partners, advertisers and other third parties. We
may also disclose and otherwise use, on an anonymous basis, consumption habits, commentary, reviews
and other non-personal information about customers.
While using the Songdish service and Web site, you will have opportunities to post profiles, songs,
reviews or other personal information in public forums. Please understand that when you post such
information, it is made public and is not subject to this policy.
Default Privacy Setting
Depending on your personal privacy settings, other users may have access to a specific set of personal information. The default privacy settings are as follows:
- As a Fan, each time you listen or send a song, your profile name and a link to your profile may be summarized in a report generated by any and all Professionals.
- As a Professional, your actions are viewable by each song owner (example: if a Professional listens to another Professional’s song, the song owner will be able to see the listener’s name & link to their Songdish profile).
Changing your Default Privacy Settings
Each member may change his/her privacy settings within your profile page.
- A Fan’s privacy settings may be changed such that only those Professionals that they are a Fan of may view the actions of the Fan. In such case, that Professional may see the Fans profile name and profile link.
- A Professional may change its privacy settings to have their actions be viewable by only the Professional’s Contacts or no one at all.
However, regardless of your Privacy Settings, in addition to the above uses of personal information, your actions will trigger your zip code and indicate whether your are a Fan or Professional, but your profile name and profile link will not be displayed.
Links to Other Sites
The Songdish Web site contains links to sites operated by third parties whose policies regarding the
handling of personal information may differ from ours. While we endeavor to associate with reputable
sites, Songdish cannot be responsible for the information handling practices of these other sites.
Children
You must be 18 years of age or older to subscribe to the Songdish service. While individuals under the
age of 18 may utilize the service, they may do so only with the involvement of a parent or legal guardian
and subject to our Terms of Use.
Viewing and Updating Your Information on Songdish
You are responsible for updating and maintaining the truth and accuracy of the personal information you
provide to us relating to your account. If you want to update your contact information or change your
payment method, you should do so by visiting the Account section of our Web site. You must be signed in
to access the Account section.
Cookies and Other Technology
As you browse the Songdish site, cookies are placed on your computer's hard drive. (Cookies are small
pieces of data that are sent to your browser from a Web server and stored on your hard drive for record
keeping purposes.) In general, cookies can make the Web more useful by storing information about your
preferences on a particular site. Cookies in and of themselves do not personally identify users, although
they do identify a user's computer. If your browser is set to not accept cookies, you will not be able to use
the Songdish site or service.

users interact with our site and to otherwise help us efficiently operate and monitor our site and service.

information that can be used to improve, operate and monitor our site and our service.

opportunity to prevent your personal information from being shared.

customers' interaction with our site, and process consumer surveys. We also provide postal addresses to

your personal information except for the purpose of providing the services we request of them.

conjunction with these partners, we may send promotional announcements and/or serve web-based
advertisements to our customers on their behalf. You can access the Communication settings within the
Profile section and request that your name be excluded from these mailings for our marketing partners. In
addition, we may offer joint promotions or programs that, in order for participation, will require personal
information be shared with third parties. In such instances, you will be provided with notice of the sharing
prior to your decision to participate.
Songdish also reserves the right to disclose personal information when we reasonably believe disclosure
is required by law, if we reasonably believe disclosure is necessary to establish or exercise legal rights, or
in situations involving potential threats to physical safety. In the event that Songdish is acquired by or
merged with a third party, we reserve the right, to sell or otherwise transfer the personal information we
have collected as part of that transaction provided that such third party continues to honor our privacy
policy.
Security
Songdish takes information security very seriously and uses reasonable administrative, technical and
managerial measures to protect your personal information from unauthorized access. For example, we
utilize Secure Sockets Layering, an industry-standard protocol for certain of your transmissions to us, in
order to encrypt the personal information that you send to us through the registration and sign up
process. We store your payment method nformation in an encrypted form.
You are responsible for maintaining the confidentiality of your account information and for restricting
access to your computer or mobile device through which you access your Songdish account. Users of
public or shared computers or unprotected mobile devices should log out at the completion of each visit to
the Songdish Web site.
Unfortunately, no security system can be guaranteed to be 100% secure. Accordingly, we cannot
guarantee the security of your personal information and cannot assume liability for improper access to it.
By using this Web site, or providing personal information to us through any means, you agree that we can
